Eviction update. From what I found out, they cannot evict my handicapped wife and our two children under State Law. They can evict me but as I was told, that would be a waste of time since my wife can then invite me back as a "guest". Since the house sale is taking longer then thought I will be seeing an attorney to contest the eviction.

If you have a signed offer with all the dates on it, then it is a legal and binding contract. So you could force them to abide by it and sell you the house by the 23rd or if they let the other guy buy it then you could be entitled to atleast the offering price that you guys signed off on. Talk to your lawyer, he should be able to send them a nice letter reminding them of the laws governing real estate transactions.

Tough call there Mars. If you lose any money as a result of this and can clearly demonstrate the loss then you have a case for breach of contract whether it is written or oral. If not then probably there is no case. What you might do is this since you are no longer obligated to the terms of your accepted offer; advise your realtor that your offer drops a hundred dollars a day every day past the 23rd. If you have not signed any documentation with your realtor you might cut him out of the picture and go directly to the realtor who has the listing. Dirty pool, but if you are not under contract it is legal. You might also consider filing a complaint with the Century 21 high mucky mucks or the board of realtors or the better business bureau and have your realtor pass along that information as well. If you have provided "Earnest Money" you should be entitled to interest and a refund.

I'm supposed to give my realtor $500. in earnest money but since the listing realtor has been messing around he says to wait. He also has talked to our mortgage company and knows that the financing is already there and they are just waiting along with us so he may never ask for the earnest money. I believe the listing realtor wants me to back out so they do not have to split the fee though I was in the office when they called and told our realtor" to fax an offer right away if he has one as we want to get rid of this dam house".(Speaker phone) I also think they may have another buyer and want me to back away so they can sell to them and again, not split the fee.

I've been upgrading my operating system to XP and needed to upgrade most of my programs to match. Well. it isn't going smoothly! I've picked up a bunch of viruses doing it and until I can get my anti-virus and Adware programs updated and running I'm stuck having a bunch of problems! I have them updated but the bugs keep giving me problems by stopping the install. They keep booting me off the internet.

The house sale is a bust. After talking directly with the listing realtors I found out the other buyer is being given all the time they want to buy the house and I would have to wait until they sent a letter refusing the sale.The other buyer is a close relative of the seller. I offered $83,000. and would drop that by $200 a day until they signed the contract with an experation date of March 30th.They called my reator and told him I would wait as long as they wanted and I would pay the full asking price of $89,900 and would have to close within 30 days.My realtor told them where to relocate their house.

Well, we are on another house. Price agreed to and contract signed but it has since "failed" the home inspection. I had sent a request for repairs to the seller and I'm waiting to get their response. We have $1,000. in this house already and don't want to give it up but I'm not about to pay $80,000. for a $50,000. house which is what I guess it's value without the repairs. The appraisal is next and in it's current state it won't muster up and my bank will not finance it.

Well, I was wrong. It appraised well above what I'm paying for it. Seems the .84 acres with the 136' of creek frontage is worth equal to the house. My realtor,home inspector and bank all agree that I'm getting a bargain and to proceed with the sale so the house is ours! Even though we will have to do some repairs before moving into the house once they are done the house/property will be worth over 6 figures and way more then the $79,900. that we are getting it for. $79,900 sale price and $3600. closing the seller is paying and $1000. for repairs. So by the end of this month we will be relocating to Tn.'s oldest town.

I had an electrician friend check the house and give an estimate of the cost for the numerous electrical problems. Total roughly $300.. Most of the cost will be hardware and instead of his $30. an hour rate he's doing it for $15.. The needed GFCI's I will buy from my employer. The company redid the restrooms and bought them in bulk to save money so now they have about 40 they do not need. They run $15. each at the store but I'm getting them for $8. for all 8 that I need.

Nope, he wasn't joking. Yes ET. We found the cause and a solution was already in place. The roof leaked onto the hardwood floors and a couple of boards are loose. They replaced the roof but had not fixed the loose boards. I'll address that when I redo the floors. All 1200 sq feet is hardwood flooring but someone covered up most of it with carpet and linoleum.Can you guess what is going to happen to the carpet and linoleum? Got to make a Lowes run today. I need a lawnmower and weed whacker and I'm ordering a drop in stove. The drop in is designed to be "dropped in" between cabinets but I'm going to have it standing by itself. Sitting on the floor it is 7" lower then a normal freestanding stove making it a better height for Julie in her chair. Then I have to order a water heater and heat pump to replace the 10 year old ones in the house now. Gonna be a busy day. In the "it figures" section of life. A hen turkey was in the backyard yesterday.

Wife went a little nuts at Lowes; 2 comfort height commodes 1 stove/oven 1 fridge/freezer(freezer is the drawer type on the bottom) 1 50 gallon water heater 1 weed wacker 1 self propelled mower with delivery and installation it came to $4320.

I had a heating repairman check out the heat pump and all is well except some "upgrades" like a new thermostat. It's a Trane system and he said it being 10 years old just means it's broken in not broken. Says I should get atleast another 10-15 years out of it. The sagging bedroom floor is from the plywood being totaly rotten from being wet. It's only effects the one corner of the room and will be easy to fix. However, the floors throughout the house are at different "levels" so I'm having it ALL built to one level. That will make things easier for my wife. I'll be losing the hardwood floors doing it though! I spent the weekend mowing and trimming the grass and yard clean up. What a job! I also managed to get half the barn/shed cleaned out and hauled out 4 wheelbarrow loads of horse pockey out of it. I now need a load of dirt to fill in where the dirt has been removed over the decades and not put back. It has left the barn floor lower then the exterior walls and outside ground level. In short, with enough rain my barn becomes an indoor pool.My daughter wants me fill fill it in with blue colored sand as the previous owners spilled a bag of it on the floor and she likes the look. Must admit a blue barn floor would be interesting.
